1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and ATA International Resources Inc. ("fyndme", "we", "us"). They govern your use of the fyndme website, apps, and services (together, the "Service"). By creating an account, uploading a photo, uploading a selfie, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What fyndme does
fyndme lets organizers upload event photos and lets attendees find photos of themselves using a selfie and facial-recognition technology. Attendees may view, download, and — where the organizer enables it — purchase photos. fyndme provides the platform; organizers are responsible for their own events, photos, pricing, and compliance.
3. Eligibility and accounts
- You must be at least 18 years old to create an account.
- You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity under your account.
- Organizer accounts may require approval by fyndme before activation, and we may decline or revoke approval at our discretion (for example, where we cannot verify the business or where these Terms are breached).
- Team members added to an organization are governed by that organization's permissions and by these Terms.
4. Acceptable use
You agree not to:
- Upload content you do not own or have the right to use, or that infringes anyone's rights;
- Upload or search for images without the consents required by law (see Sections 6 and 7);
- Use the Service to harass, stalk, surveil, or harm any person;
- Attempt to re-identify, scrape, or extract biometric data or other users' data from the Service;
- Upload unlawful, obscene, or harmful content, or content sexualizing minors;
- Interfere with, probe, or attempt to breach the security of the Service;
- Resell or misrepresent the Service, or use it to build a competing facial database.
We may remove content, and suspend or terminate accounts, that violate these Terms (see Section 10).
5. Content ownership and licenses
- Organizer content. Organizers retain ownership of the photos they upload. By uploading, you grant fyndme a non-exclusive, worldwide license to host, store, process (including facial detection and matching), display, watermark, and deliver that content solely to provide and improve the Service, including delivering matched photos to attendees and, where enabled, fulfilling purchases.
- Attendee selfies. You retain rights to your selfie. You grant fyndme a limited license to process it only to perform your search as described in the Privacy Policy.
- fyndme content. The Service itself — software, design, logos, and trademarks — belongs to fyndme and may not be copied or used without permission.
6. Organizer obligations (important)
If you use fyndme as an organizer, you represent and warrant that, for every event and photo you upload, you have:
- The right and any necessary licenses to upload and use the photos;
- A lawful basis and the consents required under the Data Privacy Act of 2012 to photograph attendees and to have their images processed by facial-recognition technology on fyndme;
- Posted clear notices at your events that photography and facial-recognition photo-finding are in use, and provided a way for attendees to object; and
- Complied with all laws applicable to your event, your pricing, and any personal data you collect (such as registration details).
You are the controller of your event content. You will indemnify fyndme for claims arising from your breach of these obligations (see Section 14).
7. Biometric data and consent (attendees)
fyndme uses facial-recognition technology. When you upload a selfie, we create a mathematical representation of your facial features and compare it against event photos to find matches. This is biometric data and sensitive personal information under Philippine law.
By uploading a selfie, you consent to fyndme processing your facial data for the purpose of finding your photos, as described in the Privacy Policy. Your consent is voluntary and you may withdraw it at any time; withdrawal stops future processing but does not affect processing already carried out. If you do not consent, do not upload a selfie — you can still contact the organizer directly for your photos.
8. Purchases, fees, and payments
- Where an organizer sells photos, prices and currency are set by the organizer and shown before purchase. Taxes may apply.
- Paid organizer plans (if any) are billed as described at sign-up.
- Payments are handled by a third-party payment processor; by purchasing you also agree to that processor's terms. fyndme does not store full card details.
- Refunds are handled per the organizer's stated policy and applicable consumer law. Digital photo downloads may be non-refundable once delivered, except where the law requires otherwise.
9. Content moderation, archiving, and takedown
To keep the Service lawful and safe, fyndme may archive (hide) or remove content — including photos, albums, and events — for example in response to a valid complaint, a data-privacy concern, a legal request, or a breach of these Terms. Archived content is hidden from organizers, attendees, and public galleries but may be retained in a restorable state before permanent deletion. We aim to notify the affected organizer, but may act first where needed to address a legal or safety risk. If you believe your rights are affected by content on fyndme, contact support@atsourcepro.com.
10. Suspension and termination
- You may stop using the Service and close your account at any time.
- We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or others.
- On termination, the licenses you granted end, except to the extent needed to complete transactions in progress, comply with law, or as reflected in backups retained for a limited period. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) survive termination.
11. Third-party services
The Service relies on third-party providers (hosting, storage, facial-recognition software, email, and payments). We are not responsible for third-party services' own acts or terms, though we choose providers with appropriate safeguards.
12. Disclaimers
The Service is provided "as is" and "as available." Facial recognition is probabilistic: matches are not guaranteed to be complete or accurate, and the Service may return partial results, miss photos, or occasionally surface a mistaken match. To the fullest extent permitted by law, fyndme disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You are responsible for verifying that matched photos are actually of you before downloading or purchasing.
13. Limitation of liability
To the fullest extent permitted by law, fyndme and its owners, staff, and providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. To the extent liability cannot be excluded, our total liability for any claim is limited to the greater of the amount you paid fyndme in the 3 months before the claim, or PHP 5,000. Nothing in these Terms limits liability that cannot be limited under Philippine law.
14. Indemnification
You agree to indemnify and hold harmless fyndme from claims, damages, and costs (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, or — for organizers — your failure to obtain the consents and rights described in Section 6.
15. Changes to the Service and these Terms
We may modify the Service and these Terms. For material changes to the Terms, we will post the updated version with a new "Last updated" date and, where appropriate, give additional notice. Continued use after changes take effect means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the proper courts of Pasig City, Metro Manila for disputes, except where mandatory consumer or data-privacy law provides otherwise. Data-privacy complaints may also be brought before the National Privacy Commission.
